Clients making a reservation with SPLVRGE will receive a Rental Invoice. This rental invoice will request a deposit or payment in full. This rental invoice and amounts therein are based on the specific property requested and corresponding nightly rate for the season requested. A client’s vacation rental is confirmed, and becomes binding, only once SPLVRGE has received payment on-time. This payment constitutes acceptance of the following rental terms and conditions on behalf of the lead guest (client) and each accompanying guest. Sending payment in response to an invoice constitutes acceptance and agreement to the following terms, conditions, restrictions and limitations as printed below. Alterations to these Property Rental Terms & Conditions or accompanying Rental Invoice are not valid. If any changes are required, a new rental invoice will be sent by the client's booking agent. Should you have any questions about the below Terms & Conditions, please contact SPLVRGE. The lead guest (client) and all other guests acknowledge that this is not a residential lease. This agreement does not constitute a dwelling; this agreement only provides access to a private rental property, rented nightly.
Payments: Please send payments by the due-date/s on the rental invoice to avoid cancellation. Submission of payment is required on or before due-dates noted on your rental invoice. Failure to make scheduled payments will subject reservations to cancellation without notice. All outstanding balances must be paid on or before due-dates noted on your rental invoice. Please note that only one credit card will be accepted per rental party for payment unless an exception is offered. Reservations made inside of 90 days of the arrival date require full payment in order to secure property. All cancellations or requests for updates to a reservation affecting payments (e.g. updating dates or updating the number of guests) must be submitted in writing to a SPLVRGE representative.
Cancellation Policy: Any changes to reservations or cancellation requests must be submitted in writing without delay. The cancellation policy specific to your property rental is noted on your rental invoice. Submission of payment constitutes legal acceptance of this cancellation policy and all accompanying Terms & Conditions. If you must change or cancel any portion of the services you have already booked, please notify SPLVRGE in writing (by email). No-shows, late arrivals, reductions in party size, and early departures are non-refundable. No full or partial refunds will be granted unless there is a serious problem occurring at the property which cannot be remedied within a reasonable timeline, and/or which causes extreme, undue discomfort or serious inconvenience (see Complaints/Maintenance section below). Monetary refunds are at the discretion of property owners or managers. SPLVRGE will work to properly arbitrate any/all disputed reservations and will work toward a satisfactory outcome. Guests who abandon their rented property without notification to, and permission from, SPLVRGE agree they will have no rights to compensation. Any approved refunds or compensation may take up to 60 days to process.
Travel Insurance: Trip cancellation insurance is highly recommended and is offered through SPLVRGE at a cost displayed on your rental invoice. For additional information and quotes for travel insurance, go to TravelGuard Insurance online.
Complaints/Maintenance: SPLVRGE works with property owners and property management services to make every effort to keep all properties and their inventories in good working order. In case of a maintenance problem, our local representatives will strive to repair the problem as soon as possible after being notified. We reserve the right to be allowed a reasonable timeline to cure a problem after a report is received. However, no refund or rate adjustment shall be made for unforeseen mechanical failures such as the supply of electricity, telephone service, internet service, water, pool filtration systems, hot tubs, air conditioning, television or cable service, appliances, etc. It is the guest’s obligation to report any problems or damage to their property immediately to SPLVRGE, regardless of the hour. Problem reports received after departure-date are not subject to compensation.
Accessibility notice: Many destinations have terrain that may vary, with villas often built into the steep hillsides. This often means great views for our guests but also that many of our properties have stairs. If a member of your party has a disability or has difficulty handling stairs, please be sure to ask about accessibility prior to booking. Be sure to let SPLVRGE know if you, or any member of your party, are on crutches or in a wheelchair needing accessible accommodations. In addition to stairs, many villas have floor plans that include open-air common spaces and bedrooms separated from the main home. If traveling with small children and you require all bedrooms to be interior rooms, it must be mentioned prior to confirming and paying your rental invoice.
Use of Rental Property: Clients may not use the property for any purpose other than a private holiday residence, nor engage in any illegal or dangerous activity and shall be sufficiently quiet and peaceful so as not to disturb neighboring properties. Clients and their guests may not bring animals to the property or have an event, such as a wedding, involving more people than scheduled and paid for at the property without written permission from SPLVRGE. Clients have exclusive use of property to include only the number of bedrooms noted on your Rental Invoice. The total number of persons allowed in the property at any one time is restricted to the number of persons scheduled and paid for, generally based on two persons per bedroom. Should a group misrepresent themselves, they will be required to pay for all excess persons immediately, or shall vacate the property without refund. Possible exceptions to this rule are made only for infants under 1-year-old; if sleeping in a baby crib and not occupying one of the villa’s beds, they are not included in the property’s total headcount. Any deviation from these rules may result in eviction without recompense.
Events: SPLVRGE wishes to maintain a safe atmosphere for the quiet enjoyment of guests. We rent to family groups and responsible adults only; absolutely no house parties or functions such as weddings are allowed without advance written permission from SPLVRGE. Guests shall be sufficiently quiet and peaceful, so as not to disturb other residents of the neighborhood, particularly after 10pm. If guests are found to have had a wedding or any sort of group gathering for more persons than officially scheduled and paid for at the property, without SPLVRGE’s advance written permission, they are subject to forfeiture of entire villa security deposit and additional charges at the joint discretion of SPLVRGE and the property’s owner.
Check-In & Check-Out Times: Guests must honor the check-in and check-out times noted on Rental Invoice. Failure to check out of your property will result in a $250 penalty charged to guest. Check-in and check-out times are strictly enforced at our properties. If you would like a later check-out time, you are required to confirm with our office or with a local manager in writing. Guests are required to get prior permission, in writing, to stay later than the published check-out time.
Villa Access: SPLVRGE designated staff may enter your rented property to perform any repairs as necessary. If your rented property is on the market for sale, property owners reserve the right to allow the home to be shown, but only by advance appointment made with guests’ permission. Every effort will be made to schedule such brief showings at a time convenient to you, to respect your privacy, and not interrupt your stay.
Keys to your rental villa: SPLVRGE shall charge guest $150 for each set of lost or mishandled keys; gate remote controls will be charged at a variable replacement cost (up to $300). Guests are required to follow all instructions precisely on where to leave your keys and gate remote controls when you depart - call local office if you are unsure.
Pets: Pets of any kind are not allowed in or on the property’s premises without specific written permission from SPLVRGE (granted prior to arrival). A pet or evidence of a pet found on premises will cause immediate eviction and forfeiture of guest’s entire rental funds.
Drugs & Hazardous Materials: Guest shall not use, or permit to be brought into any property, any illegal substances, flammable fluids (e.g., gasoline, kerosene or benzene), or other explosives or articles deemed hazardous to life, limb or property. Evidence of illegal or hazardous materials is grounds for immediate eviction and loss of rental funds.
Rates & Errors: The information pertaining to each property in SPLVRGE’s online catalog was correct upon publication, but is constantly being updated. SPLVRGE is not responsible for printing errors or inadvertent omissions to website information. Prior to receiving payment, all rates and villa details are subject to change without notice. In any dispute arising out of this rental agreement, the laws of California, United States shall apply and the prevailing party shall recover costs, expenses and attorneys’ fees. A rental invoice becomes a binding agreement when a proper rental deposit has been processed. Sending payment in response to an invoice constitutes your acceptance and agreement to these terms, conditions, limitations and restrictions as printed above. Substitution: SPLVRGE reserves the right to substitute comparable accommodations without liability, should the reserved property be sold, be out of order, been inadvertently double-booked, or be deemed substandard for any reason. If comparable accommodations are not available, guest may receive a complete refund of all pro-rated rent and hotel tax paid for original property.
Liability: SPLVRGE is acting hereunder as agent for accommodations, and assumes no liability for property loss or damages, nor liability for injury, accidents, delay, or irregularity which may be occasioned either by reason of defect in any vehicle or the acts of any company or persons engaged in conveying passengers to or from their villa. Transportation (airlines, ferries, charter vessels, rental cars and taxis) is supplied by providers who operate independently of SPLVRGE. We assume no responsibility, therefore, for any loss, injury, or damage to person or property because of the acts of providers. Guests are responsible for their property during occupancy, must lock windows and doors securely at all times when not on the premises, and must exercise care in securing all personal property. Guests must observe all cautions as given. All SPLVRGE properties are privately owned. The property owner and SPLVRGE reserve the right to refuse service or rentals to anyone at their complete discretion.
Damage Deposits: Damage deposits being held are eligible for refund 60 days post departure date, provided there is no breakage, damage, missing items, no additional cleaning, long-distance calls charged, and no other charges incurred before, during or after your stay, still outstanding. Clients will provide SPLVRGE with a damage deposit. Some deposits are noted as damage waivers and are non-refundable. Property management fees and/or standard out-cleaning costs will be retained by the property owner and will not be returned to guests. Non-refundable deposits are noted on your Rental Invoice. As a form of additional security, guests may have to submit a valid credit card in addition to a cash security deposit. SPLVRGE reserves the right to authorize client’s provided credit card for substantiated damage claims. Damages to the property by guests will be arbitrated by SPLVRGE on behalf of both parties (rental client and property owner). Unless otherwise noted on your Rental Invoice, all normal utilities (except utility usage deemed careless/excessive) are included in your rental price. Each client will be required to complete and return a Guest Fulfillment Form, attesting to the proper state of the property upon their departure, in order to begin a refund process. Rental clients hereby agree to pay SPLVRGE, on behalf of the owner of your rental property, the cleaning or replacement costs for all damages to personal property or to real estate, which may occur as a result of occupancy, excluding normal wear and tear. Renter agrees to take all reasonable steps to ensure that family and other guests in your party adhere to the rules and regulations affecting your property rental. The conduct of any illegal activity on the property by client or any of its invitees will subject client to forfeiture of payments and deposits and all other costs incurred by Owner resulting from the illegal activity or related to the repair of the property. Deposits are security for the performance by Renter of all obligations under this Agreement and against damages or loss incurred during the rental period, including but not limited to those arising from any violation of the Damage Deposits section.
Hold Harmless: You hereby release and agree to hold SPLVRGE LLC, its officers and employees, harmless from any claim, loss, damage, or cost of expense of any person occupying or visiting the accommodation arising out of personal injury, including any caused by persons or carriers conveying passengers to/from their villas, accidents or death, property loss or damages; cancelled or changed itinerary resulting from any acts or omission of the owner of the accommodation, their employees or agents, or any other party not under the direct employment and control of SPLVRGE LLC or from any act of God, war, strikes, pandemics, government or any other event or cause beyond its control. SPLVRGE LLC has made a good faith effort to accurately describe accommodations, but shall not be liable for any inaccuracies in such descriptions or changes in the accommodation or the surrounding properties or condition thereof, noise or inconvenience from nearby construction or for any temporary defects or stoppages in villa equipment or the supply of electricity, gas, water, plumbing, or any other services. SPLVRGE LLC acts as broker for the property rental and shall not be responsible for problems resulting from the solvency of the property owner; foreclosures, liens and other legal settlements affecting the viability of a confirmed rental are outside the control of SPLVRGE LLC and are not grounds for suit by, or refund to, a displaced renter. All efforts will be made in the event of service disruption to readily remedy problems through arbitration. In the event of any dispute arising from this agreement, you hereby consent to exclusive jurisdiction and venue of courts in San Francisco County, California, USA. Rental agreement is subject to the laws of the state of California (USA) which shall apply and the prevailing party will recover its costs, expenses and attorney’s fees.

Arrival: The SPLVRGE concierge staff needs to know your airline flight numbers, as well as arrival and departure times. This is essential, as our team will need this information to finalize your arrival instructions. Always travel with your list of island contact numbers in case of emergency. Be sure you remember to bring your passport and a photo ID! Always check with your airline for the latest requirements before you travel. If your flight is delayed or cancelled while en route, you are required to contact SPLVRGE so we can notify all parties involved, including your car rental company - failure to do this may result in a service related penalties.
